An Adoption Evaluation is court ordered and includes an evaluation of the circumstances as well as the condition of the home and the social environment of any person requesting to adopt a child(ren). In most cases, the State of Texas requires that an Adoption Evaluation be filed and conducted even if family members are already involved with the child(ren)’s life.Please note, that Ms. Logan only conducts uncontested Adoption Evaluations which typically include stepparents, grandparents, aunts, uncles, and other relatives.
How Long Does an Adoption Evaluation Take?
The Adoption Evaluation Process can take up to three months or longer to complete, depending on your unique circumstances. It is important that Ms. Logan is first specifically appointed via court order, and that the prospective adoptive families gather and send all the necessary/required documents to Ms. Logan. In addition, it is also vital to begin the background check process as soon as possible in order to prevent potential delays.
Texas Family Code 107.153 - Order for Adoption Evaluation
- The court shall order the performance of an adoption evaluation to evaluate each party who requests termination of the parent-child relationship or an adoption in a suit for:
- termination of the parent-child relationship in which a person other than a parent may be appointed managing conservator of a child; or
- an adoption.
- termination of the parent-child relationship in which a person other than a parent may be appointed managing conservator of a child; or
- The adoption evaluation required under Subsection (a) must include an evaluation of the circumstances and the condition of the home and social environment of any person requesting to adopt a child who is at issue in the suit.
- The court may appoint a qualified individual, a qualified private entity, or a domestic relations office to conduct the adoption evaluation.
- Except as provided by Section 107.155, a person who conducts an adoption evaluation must meet the requirements of Section 107.154.
- The costs of an adoption evaluation under this section shall be paid by the prospective adoptive parent.
